📋 Terms of Service

By downloading, installing, or using Gem Collector ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Gem Collector. By using the App, you represent that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

2. Free Play and Subscription

2.1 Free Solo Play

You may play Gem Collector in single-player mode for free without creating an account or signing in. No subscription is required for solo gameplay.

2.2 Multiplayer Subscription Requirement

To access online multiplayer features, you must:

• Sign in with Google Play Games
• Subscribe to our service through Google Play Billing
• Maintain an active subscription

2.3 Free Trial

We offer a 5-day free trial for new subscribers. You will not be charged during the trial period. The trial period begins when you subscribe.

2.4 Subscription Plans

After your free trial, you will be charged:

• Monthly Plan: $1.99 per month

Multi-Device Access: Each subscription allows access on up to 3 devices simultaneously.

2.5 Billing

• Subscriptions are billed through Google Play
• Subscriptions automatically renew unless cancelled
• Prices are subject to change with 30 days notice
• Taxes may apply based on your location

2.6 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial billing periods
• Your game progress is saved even after cancellation

2.7 Refund Policy

We offer a 7-day money-back guarantee for new subscribers. Refund requests must be submitted within 7 days of purchase through Google Play Support.

3. Authentication and Account Management

3.1 Google Play Games Sign-In

To access multiplayer features and subscription services, you must sign in with Google Play Games. By signing in, you authorize us to:

• Access your Google Play Games player ID
• Access your Google Play Games display name
• Link your subscription to your Google Play Games account

3.2 Nickname

When you first sign in, we will suggest a nickname based on your Google Play Games display name. You may customize this nickname, subject to:

• Uniqueness requirement (no duplicate nicknames in our game)
• Content standards (no offensive or inappropriate names)
• Change frequency limit (once per 30 days)

3.3 Web Portal Access

You may optionally set a portal password to access our web portal for account management, including:

• Managing authorized devices
• Viewing subscription status
• Updating optional email address
• Changing nickname (subject to frequency limits)

Note: The portal password is separate from your Google Play Games authentication and is optional.

3.4 Device Management

Each subscription allows access on up to 3 devices. You are responsible for:

• Managing which devices are authorized
• Removing devices you no longer use
• Securing your devices to prevent unauthorized access
• Not sharing your subscription with others

If you reach the 3-device limit, you must remove a device through the web portal before adding a new one.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on up to 3 devices you own or control
• Use the App for personal, non-commercial purposes
• Play solo games without signing in
• Access multiplayer features with an active subscription

5. Restrictions

You agree NOT to:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use the App for commercial purposes
• Cheat, exploit bugs, or use unauthorized third-party software
• Harass, abuse, or harm other players
• Use offensive or inappropriate usernames/nicknames
• Share your subscription with others beyond the 3-device limit
• Circumvent device limits or authentication requirements
• Create multiple accounts to abuse free trials

6. Online Multiplayer Conduct

When using online multiplayer features, you must:

• Treat other players with respect
• Not use offensive language or behavior
• Not intentionally disrupt gameplay
• Not share inappropriate content

Violation of these rules may result in suspension or termination of your account.

7. Intellectual Property

All content in the App, including:

• Graphics, artwork, and images
• Text, code, and software
• Trademarks and logos
• Game mechanics and rules

Are owned by or licensed to Gem Collector and protected by copyright, trademark, and other intellectual property laws.

8. User Content

You retain ownership of any content you create (such as nicknames and optional profile information). However, by using the App, you grant us a worldwide, royalty-free license to use, store, and display your content as necessary to provide the service.

9. Privacy

Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or harmful components
• Google Play Games Services will always be available
• Multiplayer features will be available 24/7

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or use
• Service interruptions or errors

Our total liability shall not exceed the amount you paid for the subscription in the past 12 months.

12. Termination

We may suspend or terminate your access to the App if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Abuse the device limit system
• Use unauthorized authentication methods

Effect of Termination: Upon termination, you lose access to multiplayer features but may continue playing solo mode.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of your jurisdiction. Any disputes shall be resolved through arbitration or in the courts of your jurisdiction.

16. Severability
